29 CFR 1926.451(g)(1):     Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:    -Employees were performing painting operations on a tubular welded frame scaffold while not using any type of fall protection system. Potential fall height was measured to be 12'-8".

29 CFR 1926.451(f)(15):     Ladders shall not be used on scaffolds to increase the working level height of employees, except onlarge area scaffolds where employers have satisfied the following criteria:    Employees were using a tressle ladder on the working platform of the scaffold to gain access to heights that were not accessible from the scaffold. Potential fall height was in excess of 12'-8".

29 CFR 1926.454(a):     The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.    Employees were not adequately trained in the hazards associated with working on a tubular welded frame scaffold system system in that they were working on the scaffold without any type of fall protection system.
