29 CFR 1910.134(c)(1): In any workplace where respirators are necessary to protect the health of the employee or whenever respirators are required by the employer, the employer shall establish and implement a written respiratory protection program with worksite-specific procedures. The program shall be updated as necessary to reflect those changes in workplace conditions that affect respirator use. The employer shall include in the program the following provisions of this section, as applicable: a) At the facility located in McArthur, Ohio, the employer required employees to wear respirators when entering treatment cylinders used to treat lumber with chemicals such as CCA, containing Arsenic, and the employer's respirator program did not include all of the required elements. Employees that were required to wear respirators did not receive medical evaluations as required, employees that wore tight fitting respirators did not receive annual fit tests, and did not have procedures for ensuring adequate air quality for the employees using a supplied air system.

29 CFR 1910.305(b)(1)(ii): Unused openings in cabinets, boxes, and fittings shall be effectively closed. a) At the facility, located in the drip pad area there was a panel board that was used to turn the lights to the drip pad area on and off that had an unused opening.
