OSH ACT of 1970 Section (5)(a)(1):     The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees    Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees using the freight elevator were exposed to fall hazards when the door could be opened without the car being present:    On and before 11/09/2012, employees were exposed to fall hazards of approximately 9 feet, while using the freight elevator onsite.  The hoistway doors at several levels could be opened without the elevator being at the same level.  This gave employees access to the elevator shaft at various levels.  The employer had not ensured the hoistway doors to the freight elevator were equipped with interlocks to prevent access to the elevator shaft in the absence of the elevator car.
