29 CFR 1926.651(h)(1):  Employees were working in excavations in which water was accumulating, and adequate precautions had not been taken to protect employees against the hazards posed by water accumulation:      (a)  JK Communications & Construction, Inc. dba Kleven Construction at Fourth Avenue and Fourth Street SE, Surrey, ND 58785:  On or before October 26, 2011, the employer did not ensure that employees were protected by an adequate protective system when setting a water pump in a trench approximately 6.5' deep and approximately 12' wide involving layers of clay and sandy soil with accumulating water.  Condition exposed employees to cave-in and asphyxiation hazards.

29 CFR 1926.651(k)(1):  An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift:    (a)  JK Communications & Construction, Inc. dba Kleven Construction at Fourth Avenue & Fourth Street SE, Surrey, ND 58785:  On or before October 26, 2011, the employer did not ensure that a competent person inspected this approximately 6.5' deep trench prior to the start of work and as needed throughout the shift.  A competent person did not test the soil to classify it and did not measure the depth and width of the trench to ensure the trench was sufficiently sloped or that a trenchbox or shoring was in use.  Condition exposed employees to cave-in and asphyxiation hazards.

29 CFR 1926.1053(b)(1):  Where a portable ladder was used for access to an upper landing surface and the ladder length allows, the ladder side rails did not extend at least 3 feet above the upper landing surface being accessed:    (a)  JK Communications & Construction, Inc. dba Kleven Construction at Fourth Avenue & Fourth Street SE, Surrey, ND 58785:  On or before October 26, 2011, the employer did not ensure that a portable metal ladder used to access the top of the trench was extended up at least 3 rungs or was secured.
