29 CFR 1910.146(c)(2): The employer did not inform exposed employees, by posting danger signs or by any other equally effective means, of the existence and location of and the danger posed by the permit spaces: NOTE: A sign reading DANGER-PERMIT-REQUIRED CONFINED SPACE, DO NOT ENTER or using other similar language would satisfy the requirement for a sign. On or about October 31, 2011, employees entered dump pit boots without designating these locations as permit required confined spaces. Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1910.146(e)(1): Before entry was authorized, the employer did not document the completion of measures required by 29 CFR 1910.146(d)(3) by preparing an entry permit: Note: Appendix D to 29 CFR 1910.146 presents examples of permits whose elements are considered to comply with these requirements. On or about October 31, 2011, employees entered dump pit boots without completion of an entry permit that would document measures had been taken such as, but not limited to, testing the atmosphere to verify that a safe entry could be made into the work area. Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).
