29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): Toth Industries, Inc., located at 5102 Enterprise Blvd., Toledo, OH: On or about November 21, 2011, the employer did not ensure that employees, operating forklifts Nissan (Model MCPL02A25LV, Chassis # CPL02-9P6227) and Toyota (Model 8FGCU25, S/N 32364), are competent to complete the task, exposing employees to struck-by, caught in between, and tip over hazards. The employer did not ensure that each forklift operator received formal instructions and practical training on how to operate a powered industrial vehicle, as well as operators performance was not evaluated. No additional abatement information is needed for this item.
