29 CFR 1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from fallingor flying objects, or from electrical shock and burns, shall be protected by protective helmets. a. On or about November 21, 2011 - at the above addressed jobsite, employees working below a ladder jack scaffold were not protected against falling materials and debris by the use of hard hats, therefore exposing the employees to struck-by hazards.

29 CFR 1926.451(e)(1): When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps,walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall beused. Crossbraces shall not be used as a means of access. a. On or about November 21, 2011 - at the above addressed jobsite, employees conducting siding operations from a ladder jack scaffold thirteen (13') feet and four (4") inches above the ground, were not provided with an access ladder to the scaffold platform, thereby exposing employees to the hazards associated with falls.
