29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns: On 12-01-11, an employee who was working within an excavation at a depth greater than ten (10) feet was working with the excavator operator within five feet of the four (4) foot wide bucket without wearing head protection. 29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c); the employer had not complied with the provisions of 29 CFR 1926.652(b)and (c); the employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that the excavation was sloped at an angle steeper than one and one-half horizontal to one vertical (34 degrees measured from the horizontal) in the top Type C soil layer, and steeper than one and one horizontal to one vertical (45 degrees measured from the horizontal) in the bottom Type B soil layer: On 12-01-11, at the jobsite at 4500 W. College Ave in Appleton, Wisconsin, an employee was working inside an excavation for a commercial grease tank at at a point less than three (3) feet from the near vertical access/egress wall without cave-in protection. The excavation was greater than ten (10) feet deep in Type B and Type C layered soils, and was less than 15.5 feet wide and less than 25 feet long, with near vertical walls. No Abatement Certification or Abatement Documentation required
