29 CFR 1910.178(a)(4):     Modifications and additions which affected capacity and safe operation were performed by the customer or user without manufacturers written approval, and the capacity, operation and maintenance instruction plates, tags or decals were not changed accordingly    a. At the site, the employer had not recieved approval from the forklift manufacturer prior to using a shop made man basket on the front of the forklift. The plates, tags or decals on the forklift were not changed accordingly.

29 CFR 1910.212(a)(1):     One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:    a. In the shop area, the employer did not ensure that the punch press was guarded at the point of operation to protect employees from ingoing nip points and/or flying parts.
