29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor  did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502.      a) South side of roof towards west end; On or about December 7, 2011 and at times prior thereto, the employer did not enforce the use of fall protection by two employees assisting with the installation of shingles.    Note: Abatement certification is NOT required for this item.

29 CFR 1926.20(b)(1): The employer did not initiate and maintain such programs as may be necessary to comply with this part:      a) The establishment; On or about December 7, 2011 and at times prior thereto, the employee had not initiated a plan to address the hazards associated with roofing work including the tools, equipment and materials utilized; the use of personal protection equipment including fall protection; and ladders.    Note: Abatement certification IS required for this item.
