OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, employees were exposed to crushing and fall hazards:    a)  On or about January 5, 2012 and at times prior, employees were exposed to crushing and fall hazards in excess of 15 feet while accessing and working from an elevated catwalk in the bulk plant area.  The catwalk was not mounted in a secure manner and was subject to collapse.  Portions of the catwalk were suspended by attaching wire from the catwalk around access hatches of fuel tanks.  The capacity of which these attachments would support was unknown.     Abatement note:  Feasible and acceptable methods of abatement would be to have registered structural engineer or other qualified person review the system and design new mounting brackets or independent supports and install these in accordance with local building codes.

This building contained many drums of oil stored on an elevated wood floor of unknown capacity.

29 CFR 1910.23(c)(1): Every open-sided floor or platform 4 feet or more above adjacent floor or ground level was not guarded by a standard railing (or the equivalent as specified in paragraph (e)(3) of this section) on all open sides and railings were not provided with a toeboard where required:    a)  On or about January 5, 2012 and at times prior, employees were not protected from fall hazards while accessing and working from the following areas:    1.  The top of tank #3 which employees were required to climb on top of to check tank levels.  The top of this tank did not contain any standard railings.    2.  The fueling platform which lacked standard railing around the entire elevated platform.

The railing that was in place only consisted of a top rail, no midrail was in place in the entire system.

29 CFR 1910.23(d)(1): Every flight of stairs having four or more risers was not equipped with standard stair railings or standard handrails as specified in paragraphs (d)(1)(i) through (v) of this section, the width of the stair to be measured clear of all obstructions except handrails:    a)  On or about January 5, 2012 and a times prior, employees were not protected from falls from the following deficiencies with the stair railings:    1.  The stair railing on the set of stairs used to access the catwalk lacked a midrail.    2.  The stairs to the fueling platform lacked a standard rail on one side and lacked a midrail on the rail that was in place.

29 CFR 1910.106(c)(4): Piping systems were not substantially supported and protected against physical damage and excessive stresses arising from settlement, vibration, expansion, or contraction:    a)  On or about Janaury 5, 2012 and at times prior, piping in the bulk plant and from the pump building to the fueling station areas were not supported adequately in that, long lengths of elevated piping was not mounted securely to structural supports.  Piping was resting loosely of miscellaneous items used for support.
