5a1    Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or likely to cause death  or serious physical harm to his employees in that employees were exposed to struck by and crushing hazards:    (a) Forest Mobile Home Park: On or about January 18, 2012 and at times prior thereto, employees were exposed to a struck by and crushing hazard while using vehicles such as but not limited to garbage trucks with hydraulic leaks and non functioning brakes.    (b) Forest Mobile Home Park: On or about January 18, 2012 and at times prior thereto, employees were exposed to a struck by and crushing hazard while using vehicles such as but not limited to the Ford F600 50 foot bucket truck with hydraulic leaks, oil leaks and non functioning brakes.

29 CFR 1910.133(a)(1):     Protective eye and face equipment was not required where there was a reasonable probability of injury that could be prevented by such equipment:    (a)	On or about January 18, 2012 and at times prior thereto, employees were exposed to eye and facial injuries while trimming trees from a 50 foot bucket truck with a Husqvarna 340 chainsaw without eye and face protection.  (b)	On or about January 18, 2012 and at times prior thereto, employees were exposed to eye and facial injuries while cutting tree branches, stumps and limbs on the ground with a Husqvarna 340 chainsaw without eye and face protection.
