29 CFR 1926.502(i)(4):   All covers were not color coded or marked with the word "HOLE" or "COVER" to provide warning of the hazard:      a)  Worksite, exterior - Employees were walking and working around seven skylight openings that were covered by plywood.  The plywood was not marked to provide warning of the hazard; on or about 02/13/12.      Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.501(b)(4)(i):   Each employee on walking/working surfaces was not protected from falling through holes (including skylights), more than six feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes.      a)  Worksite, Exterior - Employees were walking and working on a flat roof with seven unprotected skylight openings approximately 15ft above the ground; on or about 02/08/12.      The employer was previously cited for a violation of this Occupational Safety and Health Standard, its equivalent, or essentially similar standard 29 CFR 1926.501(b)(1) wich was contained in OSHA Inspection number 315332049 under the name DME Construction Associates, Citation number 01, Item number 01, issued on 3/23/11 and became final order on 4/19/11.       Note:   Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.
