29 CFR 1926.600(a)(3)(i): Bulldozer and scraper blades, end-loader buckets, dump bodies, or similar equipment were not fully lowered or blocked when being repaired or when not in use:    (a) On the east side of the project, on or about February 8, 2012, the outriggers were not lowered to the ground on a Case 590 Super M backhoe, Product Identification Number JJG0286670.  The backhoe was parked alongside the roadway and not in use.

29 CFR 1926.601(b)(14): All defects were not corrected before motor vehicle(s) were placed in service:    (a) At the north side of the project, on or about February 8, 2012, and at times prior thereto, the tail, and signal lights of the Case 590 Super M backhoe, Product Identification Number JJG0309560, were inoperative. Employee operated the equipment on a public roadway at about 6:30 am. Employees were exposed to potential struck-by hazards.       (b) At the east side of the project, on or about February 8, 2012, and at times prior thereto, the front left (driver's side) tire treads of the Case 590 Super M backhoe, Product Identification Number JJG0286670, were worn to the belts. Employee operated the equipment on a public roadway at about 6:30 am. Employees were exposed to potential struck-by hazards.
