As such, company employees were exposed to fall hazards when performing framing, floor sheathing installation, and other related work from a residential structure's first floor.  Conditions noted on or about 02/10/12.    NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.    Fox Brothers Construction, Inc. was previously cited for a Serious Violation of this Occupational Safety and Health standard or its equivalent standard, 29 CFR 1926.20(b)(2), which was contained in OSHA Inspeciton number 315978874, Citation 1, Item Number 1, issued on 06/07/11 with respect to a workplace located at 975 Tuckerton Road, Marlton NJ.  The citation became a final order on 01/31/12.

29 CFR 1926.501(b)(13):     "Residential construction." Each employee engaged in residential construction activities 6 feet(1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provisionin paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it isinfeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets therequirements of paragraph (k) of 1926.502.Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fallprotection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complieswith 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.    a- 3 Copley Circle, West Berlin NJ: Company employees were exposed to fall hazards, in excess of 8 feet to the ground surface below, when performing framing, floor sheathing installation, and other carpentry related activities less than six feet from a residential building's unprotected edges.  The exposed company employees were not provided/utilizing a Personal Fall Arrest System, safety nets, guardrails, etc. at the time of the inspection.  Condtion observed on or about 02/10/12.
