29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered:     (a) Top Notch Tree Service @ 304 E. Mulberry St., Fort Collins, CO 80525: On and before February 1st, 2012, the employer did not ensure that protective equipment was used in the following instances:    (1) 	Two employees were not wearing safety glasses when working around chain saws;    (2)	Two employees were not wearing hearing protection when working around chain saws;    (3)	Two employees were not wearing hard hats; including two employees working on the ground under an employee using a chain saw in a tree.    (4)             Two employees using chainsaws on the ground without the use of cut-resistant clothing.    Conditions exposed employees to the hazards of projectiles to the eyes, to hearing loss, cuts and amputations, and struck by hazards from falling debris.    Abatement Note:  Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").                                                          OR IN THE ALTERNATIVE    Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer furnish a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the following serious hazards:    (a)Top Notch Tree Service @ 304 E. Mulberry St., Fort Collins, CO 80525:  On and before February 1st, 2012, the employer did not ensure that protective equipment was used in the following instances:    (1) 	Two employees were not wearing safety glasses when working around chain saws;    (2) 	Two employees were not wearing hearing protection when working around chain saws;    (3)  	Two employees were not wearing hard hats, including one employee working on the ground under an employee using a chain saw in the tree.    (4)             Two employees using chainsaws on the ground without the use of cut-resistant chaps.      Conditions exposed employees to the hazards of projectiles to the eyes, to hearing loss; cuts and amputations, and struck by hazards from falling debris.    Abatement Note:  Among other methods, American National Standards Institute (ANSI) Z133.1 - 2000 Section 4.2 provides that one feasible and acceptable abatement method includes providing personal protective equipment and requiring its use.
