Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees a place of employment which were free from recognized hazards that were causing or are likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: A. Watertown Steel Company, LLC worksite located at 205 Rosenberger Dr., Bluffton, Ohio: On or about February 16, 2012, the employer did not ensure the anchorage device used to hoist the steel deck sheets was used in accordance with ASME B30.26, Rigging Hardware. The NS Fall Hinged Reusable Roof Anchor is intended to be used as part of a personal fall arrest system. Among other methods, one feasible and acceptable abatement method to correct this hazard would be to comply with ASME B30.26, Rigging Hardware.

29 CFR 1926.1402(b): The equipment was not assembled or used where ground conditions are firm, drained, and graded to a sufficient extent so that, in conjunction (if necessary) with the use of supporting materials, the equipment manufacturer's specifications for adequate support and degree of level of the equipment are met. A. Watertown Steel Company, LLC worksite located at 205 Rosenberger Dr., Bluffton, Ohio: On or about February 16, 2012, the employer did not ensure the ground conditions and supporting material for the Grove RT635C crane was sufficient. Uneven cribbing was observed under the jack pads causing the crane to shift.
