29 CFR 1926.34(c): Means of egress was not continually maintained free of all obstructions or impediments to full instant use in the case of fire or other emergency:    a)  Emergency egress from the cellar construction area was obstructed; the exit door leading out to the sidewalk was screwed shut due to not having the proper egress hardware, such as a panic bar, that will allow construction personnel to egress but prevent unauthorized entry from the street.     b)  Both exit stairs had items being stored on the stairway which can cause trip hazard or obstruction in a fire or smoke emergency.    Location:  254 W 54th St,  New  York, N.Y.     On or about 2/23/2012     NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.403(i)(2)(i): Live parts of electric equipment operating at 50 volts or more were not guarded against accidental contact by cabinets or other forms of enclosure:    a)  The circuit breaker panel located in the hallway of the cellar construction area did not have a cover; live busbars were exposed.  During construction activities employees may carry metal objects such as wire, pipe or metal doors which may contact the live busbars. Employees were exposed to electric shock hazard.     Location:  254 W 54th St,  New  York, N.Y.     On or about 2/23/2012     NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.501(b)(4)(ii): Each employee on a walking/ working surface was not protected from tripping or stepping into or through holes by covers:    a)  During construction activities employees were exposed to stepping into 2 ft deep floor holes in the cellar floor.  The employer was installing plumbing in the cellar construction area and did not provide a sufficient floor hole covers at the high traffic area near the hallway.
