29 CFR 1926.95(a): "Application." Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact. At the site, employees were not wearing safety glasses and gloves while mixing and applying stucco containing cement. The lack of personal protective equipment exposed employees to skin irritation and eye injury.

29 CFR 1926.451(f)(14): Makeshift devices, such as but not limited to boxes and barrels, shall not be used on top ofscaffold platforms to increase the working level height of employees. At the site on the 2nd tier of a tubular welded scaffold, employees were standing on planks resting on buckets, to increase their working height while applying stucco to a building exterior. This condition exposed employees to possible fall hazards.

29 CFR 1926.451(h)(1): In addition to wearing hardhats each employee on a scaffold shall be provided with additionalprotection from falling hand tools, debris, and other small objects through the installation of toeboards, screens, or guardrail systems, or throughthe erection of debris nets, catch platforms, or canopy structures that contain or deflect the falling objects. When the falling objects are toolarge, heavy or massive to be contained or deflected by any of the above-listed measures, the employer shall place such potential falling objects awayfrom the edge of the surface from which they could fall and shall secure those materials as necessary to prevent their falling. At the site, on the 1st and 2nd tier of a tubular welded scaffold, employees were applying stucco above each other without toeboards to prevent tools and materials from falling.
