29 CFR 1910.134(a)(1): The employer did not provide feasible and or acceptable engineering controls to prevent atmospheric contamination resulting in employees being exposed to harmful dusts, fogs, fumes, mist, gasses, smokes, sprays or vapors. When effective controls are not feasible or while they are being instituted, appropriate respirators shall be used. This section applies to General Industry (Part 1910), Shipyards (Part 1915), Marine Terminals (Part 1917), Longshoring (Part1918) and Construction (Part 1926): a) On or about 03/21/12 at 55 Blackhorse Court, Staten Island, NY 10306 employer allowed two employees to dry cut concrete pavers exposing them to silica dust when the employer did not provide any feasible and or acceptable engineering controls to prevent their exposure to this harmful dust.

29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury: a) On or about 03/21/12 at 55 Blackhorse Court, Staten Island, NY 10306 employer allowed two employees to dry cut concrete pavers, one operating a Milwaukee 6" grinder and the second employee operating a STIHL gas powered cutoff saw when neither of these men were wearing any eye and or face protection exposing them to eye and face injuries.
