29 CFR 1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms while the entire platform was not attached to the fork: a) At the worksite, at the dumpster, on or about 3/20/12: An employee used an an all terrain forklift to elevate a wooden pallet with a wheelbarow full of rubble on it, above the top of a dumpster. The employee then climbed the dumpster to step onto the pallet and pour the material in the wheelbarrow into the dumpster below, exposing the employee to a fall in excess of 6 feet.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. a) At the worksite, at the dumpster, on or about 3/20/12: An employee used an an all terrain forklift to elevate a wooden pallet with a wheelbarow full of rubble on it, above the top of a dumpster. The employee then climbed the dumpster to step onto the pallet and pour the material in the wheelbarrow into the dumpster below, exposing the employee to a fall in excess of 6 feet. This employee was not trained on how to work on this type of elevated scaffold platform. Abatement certification must be submitted for this item.
