OSH ACT of 1970 Section (5)(a)(1):     The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees.    On or about April 11, 2012 and times prior thereto, employees of Discount Tire & Brake, LLC performed autmotive maintenance in the maintenance bay of the facility located at 7325 Kanis Road in Little Rock, Arkansas.  The employer had installed schedule 40 polyvinyl chloride (PVC) pipe throughout the walls and ceilings of the facility to inlude the maintenance bay.  The PVC pipe was used to transport compressed air throught the facility, exposing employees to the hazards of flying shrapnel in the event the PVC pipe were to explode.

29 CFR 1910.212(a)(1):     Machine guarding was not provided to protect operator(s) and other employees from hazard(s) created by:    On or about April 11, 2012 and times prior thereto, employees of Discount Tire & Brake, Inc. operated brake lathes to turn rotors for brake replacement in the maintenance bay of the facility located at 7325 Kanis Road in Little Rock, Arkansas.  Three instances of unguarded brake lathes were observed as follows:    a)  An AMMCO electronic feed brake lathe with serial number 1109605373 was observed with the chip guard removed, exposing employees to potential struck by hazards.    b) An AMMCO electronic feed brake lathe with serial number 1109605374 was observed with the chip guard removed, exposing employees to potential struck by hazards.    c) An AMMCO safe turn brake lathe with serial number 0701600698 was observed with the chip guard removed, exposing employees to potential struck by hazards.

29 CFR 1910.215(a)(2):     Abrasive wheel(s) used on grinding machinery were not provided with safety guard(s) which covered the spindle end, nut, flange projections:    On or about April 11, 2012 and times prior thereto, employees of Discount Tire & Brake, Inc. performed grinding tasks to sharpen tools such as but not limited to chisels with the use of a Ryobi bench grinder, model BGH826.  An abrasive grinding wheel had been installed on the left side and a wire brush wheel had been installed on the right side of the grinder.The bench grinder observed did not have side guards installed on both the left and right sides of the bench grinder.

29 CFR 1910.215(b)(9):     Guard for abrasive wheel machine where the operator stands in front of the machine was not constructed so that the peripheral protecting member could be adjusted to the constantly decreasing diameter of the wheel:    On or about April 11, 2012 and times prior thereto, employees of Discount Tire and Brake, Inc. peformed grinding tasks to sharpen tools such as but not limited to chisels with a Ryobi bench grinder, model BGH826.  The bench grinder observed did not have a guard installed such as a tongue guard on the left side of the bench grinder where an abrasive wheel was used, exposing employees to imaplement hazards in the event the abrasive wheel was to shatter.

29 CFR 1910.305(a)(2)(ix):     Lamps for general illumination were not protected from accidental contact or breakage by a suitable fixture or lampholder with a guard.    On or about April 11, 2012 and times prior thereto, employees of Discount Tire & Brake, Inc. operated a Ryboi bench grinder, model BGF826.  A light fixture was installed on the grinder with no guarding.  A bulb was used, exposing employees to the hazards of shards of glass in the event accidental contact with the bulb was made.
