29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns: On or about April 4, 2012, employees walking and working below employees on a commercial roof removing and installing roofing material were not wearing protective helmets (hard hats) to prevent head injuries from falling roofing material, and hand tools. Employees were exposed to the hazard of being struck in the head by flying and falling objects.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On or about April 04, 2012, employees removing roofing material from a commercial roof approximately 18 feet from the crest and approximately 8 feet from the fascia were not protected from falling to the ground below.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access: On or about April 04, 2012, employees working on a commercial roof accessed the roof by a ladder that did not extend 3 feet above the upper landing surface. Employees were exposed to the hazard of falling approximately 11 feet to the concrete below.
