29 CFR 1910.23(c)(1):     Every open-sided floor or platform 4 feet or more above adjacent floor or ground level shall beguarded by a standard railing (or the equivalent as specified in paragraph (e)(3) of this section) on all open sides except where there is entrance toa ramp, stairway, or fixed ladder. The railing shall be provided with a toeboard wherever, beneath the open sides,      a) Kmart Corporation  2873 West 26 th Street, Erie, PA: On or about April 13, 2012 an employee was walking/working on the roof by adding a sprinkler system to the roof over the home and garden center. The roof was greater than 6 feet from ground level. The worker was not protected from falling by guardrail systems and/or other fall protection devices.    IN THE ALTERNATIVE:  29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered:    a) Kmart Corporation  2873 West 26 th Street, Erie, PA: On or about April 13, 2012 an employee was walking/working on the roof by adding a sprinkler system to the roof over the home and garden center. The roof was greater than 6 feet from ground level. The employee working on the roof was not utilizing personal fall arrest systems, personal fall restraint systems, and/or other fall protection devices.
