OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing for likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards and struck against hazards: a) Parts Room - The employer failed to failed to ensure safe placement and use of fiberglass, self-supporting ladders, in that a ladder was permitted to be used as a single ladder, in the partially closed position to reach upper shelves. The employer did not ensure that ladder use was restricted to the purpose for which the ladder was designed for. Employees were exposed to a fall hazard of approximately 10 feet. In accordance with 29CFR 1903.19(c), abatement certification is required for this violation (using CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement or other written records.
