29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502. (a) Jobsite, 1614 Ligonier Street, Latrobe, PA: On or about 04/18/12, employees engaged in residential construction activities approximately 20 feet above the ground were not protected from falling by the use of guardrail systems, safety net systems or personal fall arrest systems. In addition, the employer did not demonstrate that it was infeasible or created a greater hazard to use these types of systems in order to implement a fall protection plan in accordance with paragraph (k).

Note: The following appendices to subpart M of this part serve as non-mandatory guidelines to assist employers in complying with the appropriate requirements of subpart M of this part.[59 FR 40738, Aug. 9, 1994; 60 FR 5131, Jan. 26, 1995] (a) Jobsite, 1614 Ligonier Street, Latrobe, PA: On or about 04/18/12, employees were not retrained on the use of fall protection when inadequacies in the affected employee's knowledge indicated that the employees had not retained the requisite understanding or skill necessary to utilize fall protection systems or equipment. Employees were performing residential construction activities and exposed to fall hazards of approximately 20 feet and no fall protection systems were in use.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: (a) Jobsite, 1614 Ligonier Street, Latrobe, PA: On or about 04/18/12, employees engaged in residential construction activities used a portable ladder, 32 ft. in length, to access the roof area approximately 20 feet above the ground and the ladder side rails did not extend at least 3 feet above the landing area. Only 1 foot of the ladder extended above the surface and no grab-bar was in place to assist employees ascending or descending via the ladder.
