29 CFR 1926.501(b)(1):  Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:    On or about April 18, 2012, and times prior therto, employees were installing siding on an apartment complex structure at a height of more than six (6) feet above ground level without using fall protection.  This exposes employees to fall hazards.

29 CFR 1926.602(c)(1)(ii):  Modifications or additions which affect the capacity or safe operation of the equipment were made without the manufacturer's written approval:    On or about April 18, 2012, and times prior thereto, the employer conducted work using a GEHL forklift truck, Model RS6-42, to support an elevated work platform without manufacturer's approval.  This exposes employees to fall hazards.
