29 CFR 1910.23(c)(1):     Every open-sided floor or platform 4 feet or more above adjacent floor or ground level was not guarded by a standard railing (or the equivalent as specified in paragraph (e)(3) of this section) on all open sides except where there is entrance to a ramp, stairway, or fixed ladder. The railing was not provided with a toeboard wherever, beneath the open sides.      On or about April 26, 2012, employees were exposed to fall hazards in that the employer did not install a standard guard rail on all open sides of the square frac tanks.

29 CFR 1910.146(c)(1):     The employer did not evaluate the workplace to determine if any spaces were permit-required confined spaces.   NOTE: Proper application of the decision flow chart in Appendix A to section 1910.146 would facilitate compliance with this requirement.    On or about April 26, 2012, employees were exposed to asphyxiation hazards in that the employer did not evaluate the square frac tanks to determine if it was a permit-required confined space.

29 CFR 1910.253(b)(4)(iii):     Oxygen cylinders in storage were not separated from fuel-gas cylinders or combustible materials (especially oil or grease), a minimum distance of 20 feet (6.1 m) or by a noncombustible barrier at least 5 feet (1.5 m) high having a fire-resistance rating of at least one-half hour.    On or about April 26, 2012, employees were exposed to fire/explosion hazards in that the employer did not ensure that oxygen and acetylene cylinders were stored at a minimum distance of 20 feet.
