29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:    a) On or about April 19, 2012, and at times prior, CC Residential, LLC, as controlling employer, did not ensure that  Q-3 Contracting, Inc., a subcontractor, protected their employees from injury in that, the spoil pile was within 2 feet of the edge of the trench.    Abatement Note:  Abatement certification and documentation is required for this item (see enclosed "Certification of Correction Action Worksheet").

29 CFR 1926.1051(a): Stairway(s) or ladder(s) were not provided at all personnel points of access where there was a break in elevation of 19 inches (48 cm) or more, or no ramp, runway, sloped embankment, or personnel hoist was provided:      a) On or about April 19, 2012, and at times prior, CC Residential, LLC, as controlling employer, did not ensure that  Westar Framing, Inc., a subcontractor, protected their employees from injury in that, employees were using 4 pallets to gain access to the job trailer supply room.    Abatement Note:  Abatement certification and documentation is required for this item (see enclosed "Certification of Correction Action Worksheet").
