29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired:    a) On or about April 19, 2012, and at times prior, CC Residential, LLC, as controlling employer, did not ensure that  Westar Framing, Inc., Losaw Electric, Inc., T.D. Industries, Inc., Pearson Mechanical, Inc., and EZ Heating & AC, subcontractors, protected their employees from injury in that, employees were using job made ladders that had defects such as but not limited to, excessive cracks, inproperly inset rungs and incorrect blocking of rungs.    Abatement Note:  Abatement certification and documentation is required for this item (see enclosed "Certification of Correction Action Worksheet"). 29 CFR 1926.405(a)(2)(ii)(I): Flexible cords and cables used for temporary wiring were not protected from damage:    (a) On or about April 19, 2012, and at times prior, CC Residential, LLC, as the controlling employer, did not ensure that Westar Framing, Inc., a subcontractor, protected their employees from injury in that, flexible cords were being run over by vehicles/forklifts.    Abatement Note:  Abatement certification and documentation is required for this item (see enclosed "Certification of Correction Action Worksheet").
