29 CFR 1926.651(c)(2):     A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:    The employer does not provide a stairway, ladder, ramp or other safe means of egress for employees to use while working in a trench. This violation was observed on or about May 3, 2012, at the job-site where employees were exposed to a fall hazard when working inside of a trench excavation without a safe means of egress.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that a safe means of egress is available for employees to use while in a trench.

29 CFR 1926.652(a)(1):     Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c).     The employer does not protect its employees from cave-ins while working in a trench.  This violation was observed on or about May 5, 2012, at the job-site where employees were exposed to a struck-by hazard when working inside of a trench excavation without an adequate protective system.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that an adequate protective system is available for employees to use while in a trench.
