OSH ACT of 1970 Section (5)(a)(1):     Section 5(a)(1) of the Occupational Safety and Health Act of 1970. The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employee in that employees were exposed to hazardous conditions when they removed critical bracing from gazebo and did not re-secure resulting in its collapse.        a) On or about 05/10/12 at 4517 Hylan Blvd., Staten Island, NY 10312 the employer along with his employee removed critical bracing from a gazebo and did not re-secure gazebo before starting work.
