29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net systems, or personal fall arrest system, nor were other provisions of paragraph (b) of this section used to provide an alternative fall protection measure:    a) On or about May 15, 2012, Kastner Company, as the controlling employer, did not ensure the El Patto Construction, a subcontractor, protected their employees from falls in excess of 9 feet, while working near the edge of and/or walking across the roof area without fall protection. 29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9m) above the upper landing surface to which the ladder was used to gain access:    a) On or about May 15, 2012, Kastner Company, as the controlling employer, did not ensure the El Patto Construction, a subcontractor, protected their employees from falls in excess of 7 feet. The extension ladder used to access the roof was not secured in place nor did the side rails of the ladder extend at least 3 feet above the upper landing surface. 29 CFR 1926.1053(b)(13): The top or top step of a step ladder was used as a step:    On or about May 15, 2012, Kastner Company, as the controlling employer, did not ensure the El Patto, a subcontractor, employees did not stand on the top step of 6 foot step ladder.  Framers working off of the top step were exposed to fall hazards in excess of 7 feet while they were extending the roof area above the front door.
