29 CFR 1910.132(a):     Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered:    a)    357 Seventh Street, On the Building's Roof, Jersey City, NJ.    Employees were exposed to falls of approximately 35 to 40 feet to the sidewalk below while conducting kitchen exhaust system maintenance on the flat roof without the use of any methods of fall protection.            Violation observed on or about 05/19/2012.

29 CFR 1910.132(d)(1):     The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE):    a)    357 Seventh Street, On the Building's Roof, Jersey City, NJ.    The employer had not assessed this worksite for hazards such as the location-specific fall hazards which would require workers performing kitchen exhaust system maintenance work to use fall protection.            Violation observed on or about 05/19/2012.
