29 CFR 1926.451(e)(1):     When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.    a) On or about 5/24/12 at the Special Events Recreation Center located at SUNY Brockport, Brockport, New York; an employee using a scissor lift to access the top of a canopy positioned the platform approximately 4 feet below the height of the canopy. The employee then used the guard rail system to climb on to and off from the canopy.    NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.453(b)(2)(iv):     Employee(s) working in an aerial lift were sitting or climbing on the edge of the basket:    On or about 5/24/12 at the Special Events Recreation Center located at SUNY Brockport, Brockport, New York; employees using a JLG aerial lift were standing on the guard rails to install panels for a canopy.    NO ABATEMENT CERTIFICATION REQUIRED
