29 CFR 1926.21(b)(2):     The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:    a) Lot 296 Harlequin Loop, Heritage Shore, Bridgeville, DE - An employee was working in an unprotected excavation approximately 8' deep, approximately 12 to 14' wide and approximately 12' long. The employer did not instruct the employees at this job site in the recognition and avoidance of unsafe conditions in excavation work. This job site experienced a cave-in which resulted in a fatality. The violation occurred on or about May 24, 2012.

29 CFR 1926.651(k)(1):     Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that resulted in a cave-ins.                                              a) Lot 296 Harlequin Loop, Heritage Shore, Bridgeville, DE - The employer did not have a  person trained to conduct daily inspections of excavation, adjacent areas and protective systems, so they could recognized hazards associated with trenching and excavation, and take prompt correction action to eliminate hazards. This resulted in cave-in and the death of the employee. This occurred on or about May 24, 2012.
