29 CFR 1910.176(b):     Material stored in tiers was not stacked, blocked, interlocked or limited in height so that it was stable and secure against sliding and collapse:    a- Lotito Foods, "Old Dock Area", Aisle #240 - The storage rack was bent to the point where the anchor to secure the rack to the floor was pulled up and raised off the floor, making the rack unstable.    Condition noted on or about 5/31/12.

29 CFR 1910.178(l)(2)(ii):     Training did not include an evaluation of the operator's performance in the workplace:    a- Lotito Foods Inc. - Forklift operators hired through temporary agencies were not evaluated in forklift operations to ensure the effectiveness of the training received.    The employer must also certify that each employee was trained and evaluated.  The certification is to include, but not be limited to, the name of operator, the date of the training or evaluation, and the name of the person providing the training or evaluation, etc.    Condition noted on or about 5/31/12.

29 CFR 1904.4(a):     Each employer required by this Part to keep records of fatalities, injuries, and illnesses must record each fatality, injury and illness that was work-related, a new case and meets one or more of the general recording criteria:    a- Lotito Foods, Inc. Edison, NJ - A recordable injury which resulted in both Days Aways and Restricted work was not recorded on the OSHA 300 log for calendar year 2012.  A forklift driver sustained on left ankle injury on 2/13/12 which resulted in 20 Days away from work and 45 days restricted duty.     Condition noted on or about 5/31/12.
