NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.501 (b)(1): Employees on a walking/working surface with an unprotected side or edge which was 6 feet or more above the lower level were not protected from falling by use of a guardrail system, safety net system or personal fall arrest system.    a) AMC 8 Movie Theatre, 800 Route 73 North, Marlton, NJ 08053: On or about May 29, 2012, the employer did not ensure that each employee engaged in roof work was protected from falling. Employees were exposed to falls of approximately 13ft.

29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:    Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated    a) AMC 8 Theatre, 800 Route 73 North, Marlton, NJ 08053: On or about May 29, 2012, an employee working from the basket of an aerial lift was not protected from falls by the use of a fall restraint system.
