29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person:    (a)  Diaz Broder Roofing, 3995 Irving Street, Denver, CO:  The exposing employer had not ensured a competent person conducted frequent inspections to identify and correct hazards associated with commercial roofing work.  On or about March 31, 2012, employees were permitted to work on a 12/12 and 4/12 pitch roof without an appropriate fall protection system.  Condition exposed employees to a fall hazard up to an estimated 20 feet.    Note: OSHA defines a "competent person" as someone capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them. 29 CFR 1926.501(b)(13):  Employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph (b):    a) Diaz Broder Roofing , 3995 Irving Street, Denver, CO:  The exposing employer had not ensured the use of appropriate fall protection while employees removed and installed new roof shingles.  On or about March 31, 2012, employees were permitted to work on 12/12 and 4/12 pitch roofs without an appropriate fall protection system.  Condition exposed employees to a fall hazard of approximately 20 feet.    Note:  If the employer determines using these systems is infeasible or created a greater hazard, the employer must develop and implement a fall protection plan meeting the requirements of paragraph (k) of 1926.502.
