29 CFR 1926.451(a)(6):     Scaffolds were not designed by a qualified person:      At the southside of the structure under construction at this job site, employees installed strofoam squares on the face of the structure from a 3-sided box used as a scaffold platform. The scaffold was job-fabricated and not designed by a qualified person.

29 CFR 1926.451(g)(1)(vii):     Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.      At this job site, at the south side of the structure under construction, a 3-sided box used as a scaffold platform and elevated by a Lull fork lift truck did not have guardrails on the open side of the box; no other form of fall protection was being used. Employees were exposed to falls from the 3-sided box.
