29 CFR 1926.453(b)(2)(v): A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).    a.  On or about June 6, 2012 - at the above addressed jobsite, employees using the PRO-126 Snorkelift telescopic boom aerial lift to gain access to and from the roof were not wearing body belts or full body harnesses, thereby exposing the employees to the hazards associated with a fall of approximately sixteen (16) feet eleven (11) inches.

29 CFR 1926.454(a): The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable:    a.  On or about June 6, 2012 - at the above addressed jobsite, employees using the PRO-126 Snorkelift telescopic boom aerial lift to gain access to and from the roof were not authorized and or trained to recognize the hazards associated with the use of aerial lifts, thereby exposing employees to the hazards associated with falls.

29 CFR 1926.501(b)(10): "Roofing work on Low-slope roofs." Except as otherwise provided in paragraph (b) of this section, each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width (see Appendix A to subpart M of this part), the use of a safety monitoring system alone [i.e. without the warning line system] is permitted.    a. On or about June 6, 2012 - at the above addressed jobsite employees conducting flat roofing operations approximately sixteen (16) feet eleven (11) inches above the ground were not protected from falls, thereby exposing employees to fall hazards.

The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.    a. On or about June 6, 2012 at the above addressed jobsite, the employer failed to provide a training program for each employee who might be exposed to fall hazards, thereby exposing employees to fall hazards.
