29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it was infeasible or that it created a greater hazard to use these systems, and did not develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) Jiro Construction at 8154 E. 33rd Ave., Denver, CO 80238: On or before June 2, 2012, the employer did not ensure that employees were protected from falling in the following instances: 1) An employee was sheathing the roof with a 12 in 12 pitch without the use of fall protection; and 2) Employees were framing on the second floor of this house, and 18 window wall openings had their base set at 36". No guardrails were in place over the window wall openings. Conditions exposed employees to fall hazards of up to 25 feet from ground to eave. Abatement note: 1926.502(b) provides that the top height of a guardrail system shall be 42 inches +/- 3 inches.

29 CFR 1926.1053(b)(13): The top or top step of a stepladder was used as a step: a) Jiro Construction at 8154 E. 33rd Ave., Denver, CO 80238: On or before June 2, 2012, the employer provided a 6 foot stepladder for use in accessing the upper trusses about 10' high, and the top and top step of the ladder was used as a step. Condition exposed employees to fall hazards of up to 10 feet from the second floor to the roof trusses.
