29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: A). On or about 06/06/12, at the site of 57-54 Page Place. Maspeth, NY Employees working underneath of scaffolds were in danger of head injury from falling objects such as, but not limited to tools and bricks from other employees who on the second section of the scaffolds. Protective helmets were not worn. ABATEMENT VERIFICATION IS REQUIRED PURSUANT TO 29 CFR 1903.19

29 CFR 1926.451(g)(4)(xv): Crossbracing used in place of a midrail was unacceptable because the crossing point of two braces is between 20 inches (0.5 m) and 30 inches ((0.8 M) above the work platform or as a toprail when the crossing point of two braces is not between 20 inches (0.5 m) and 30 inches (0.8 m) above the work platform or as a toprail when the crossing point of two braces is between 38 inches (0.97 m) and 48 inches (1.3 m) above the work platform. The endpoints at each upright were more than 48 inches (1.3 m) apart: a). On or about 04/18/12, scaffolds at 577-54 Page Place. Maspeth, NY Employees bricklaying exterior wall on scaffolds were exposed to the hazard of falling approximately 18 ft. The midrail on the scaffolds were missing. ABATEMENT VERIFICATION IS REQUIRED PURSUANT TO 29 CFR 1903.19.

Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. A). On or about 06/06/12, on the third floor of 57-54 Page Place. Maspeth, NY Employees bricklaying exterior wall on the top of the canopy were not protected from falling. The employees were exposed to the hazard of falling approximately 15 ft to the ground at the exterior of the building. ABATEMENT VERIFICATION IS NOT REQUIRED PURSUANT TO 29 CFR 1903.19.
