29 CFR 1926.451(e)(1):   Scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, without any portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface in place:    At the site, on June 6, 2012, on the east sides of the building, where employees were applying stucco from the second tier of a tubular welded scaffold, they were accessing and egressing from their working level using the crossbracing and legs of the scaffold, as there was no ladder provided.

29 CFR 1926.451(g)(1)(vii):   For all scaffolds not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, each employee was not protected by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section:    At the site, on June 6, 2012, on the east side of the building, where employees were applying stucco from the second tier of a tubular welded scaffold, there was no guardrail system or other means of protecting them from a fall of greater than 10 feet.

29 CFR 1926.454(a):   The employer did not have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards:    At the site, on June 6, 2012, where employees were working on scaffolds with deficiencies such as, but not limited to, no ladders and no guardrail or fall protection system, they had not been effectively trained to recognize these hazards.
