OSH ACT of 1970 Section (5)(a)(1):     The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards associated with entering a confined space including asphyxiation.    a) In the old wet well at lift station #2, on or about March 26, 2012, employees entered the wet well where sewage was present without testing the atmosphere, without using forced air ventilation, and without utilizing rescue equipment including a body harness, resulting in an asphyxiation hazard.

OSH ACT of 1970 Section (5)(a)(1):     The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to being struck by a violently dislodged pneumatic pipe plug.    a) In the old wet well at lift station #2, on or about March 26, 2012, an employee who was standing directly in front of an improperly installed pneumatic pipe plug was exposed to being struck by the plug due to its failure resulting in the plug violently dislodging.

29 CFR 1926.501(b)(7)(ii):     Each employee at the edge of a well, pit, shaft, or  similar excavation 6 feet (1.8 m) or more in depth was not protected from falling by guardrail systems, fences, barricades, or covers:    a) At the lift station #2 old wet well, on or about March 26, 2012, employees who were standing above the wet well while staging equipment were exposed to falling through two unprotected openings into the fifteen-foot deep well.
