29 CFR 1926.451(c)(2): Supported scaffold poles, legs, posts, frames, and uprights did not bear on base plates and mud sills or other adequate firm foundation: On or about June 19, 2012, two employees were observed working on a three-tier scaffold erected along the backside of the house without base plates attached. The employees were exposed to fall hazards of 17-feet 10-inches and 11-feet 7-inches to the ground.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems. On or about June 19, 2012, an employee was observed working on top of the back porch while plastering the backside of the house. The employee did not have any form of fall protection and was exposed to a fall of 11-feet 7-inches to the ground.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet above a lower level were not protected from falling to that lower level. On or about June 19, 2012, two employees were observed working on three-tier scaffolds erected along the corner and backside of the house without any form of fall protection. a) Employee #1 working at the backside of the house was observed on the 3-tier scaffold without any form of fall protection. The upper scaffold was not equipped with guardrails. The employee was exposed to a fall hazard of 17-feet 10-inches to the ground. b) Employee #2 at the back corner of the house was observed standing at the edge of the scaffold while texting on his cell phone. The employee was exposed to a fall hazard of 13-feet, 2-inches to the ground. SERGIO GUZMAN WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.451(G)(1), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 313498842, CITATION NUMBER 01, ITEM NUMBER 001(A) AND WAS AFFIRMED AS A FINAL ORDER ON NOVEMBER 11, 2011, WITH RESPECT TO A WORKPLACE LOCATED AT 11508 FITO MOLINA, EL PASO TX79924.

29 CFR 1926.451(h)(1): Each employee on a scaffold was not provided with additional protection from falling hand tools, debris, and other small objects through the installation of toeboards, screens, guardrail systems, or through the erection of debris nets, catch platforms, or canopy structures that contain or deflect the falling objects. For falling objects too large, heavy or massive to be contained or deflected, the employer did not place and secure such potential falling objects away from the edge of the surface from which they could fall. On or about June 19, 2012, five employees working below (wearing hardhats) on a scaffold were not provided with additional protection from falling hand tools, debris, and buckets full of plaster, through the installation of toeboards.
