29 CFR 1926.451(e)(1): When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall be used. Crossbraces shall not be used as a means of access.    a.  On or about June 14, 2012 - at the above addressed jobsite, employees conducting roofing operations from a ladder jack scaffold approximately twenty three (23) feet four (4) inches above the ground were not provided with an access ladder, thereby exposing the employees to fall hazards.

Except as otherwise provided in paragraph (b) of this section, each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width (see Appendix A to subpart M of this part), the use of a safety monitoring system alone [i.e. without the warning line system] is permitted.    a.  On or about June 14, 2012 - at the above addressed jobsite, an employee performing roofing operations approximately eleven (11) feet seven (7) inches above the ground was not protected from falls, thereby exposing employees to fall hazards.    THE CHAMPION ROOFING, INC. WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 1926.501(b)(10), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 314604737, CITATION NUMBER 1, ITEM NUMBER 4 AND WAS AFFIRMED AS A FINAL ORDER ON JANUARY 10, 2011 WITH RESPECT TO A WORKPLACE LOCATED 7655 DEMPSTER, NILES, ILLINOIS  60714.
