29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  (a) Phoenix Premium Outlet Construction Site, Gila River Indian Reservation: On or about June 7, 2012 and at times prior thereto, employees were in a trench, approximately 8 feet deep, and exposed to a cave-in hazard when they were in unprotected areas of the trench.

29 CFR 1926.651(j)(1): Adequate protection was not provided to protect employees from loose rock or soil that could pose a hazard by falling or rolling from an excavation face:  (a) Phoenix Premium Outlet Construction Site, Gila River Indian Reservation: On or about June 7, 2012 and at times prior thereto, an employee pulled wire through a pipe in an unshored section of the trench when a large clump of dirt fell into the trench and injured him. The trench was approximately 100 feet long, 3 feet wide and 10 feet deep.

29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift:  (a) Phoenix Premium Outlet Construction Site, Gila River Indian Reservation:  On or about June 7, 2012 and at times prior thereto, cracks existed near the top of the excavation and a section of the wall was concave when an employee pulled wire through a pipe in an unshored section of the trench. Had inspections of the trench been conducted as required, the competent person would have removed the exposed employee. The trench was approximately 100 feet long, 3 feet wide and 10 feet deep.
