29 CFR 1926.501(b)(1):  Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  The employer does not ensure each employee on a walking/working surface with an unprotected side or edge that is 6 feet or more above a lower level is protected from falling by the use of a guardrail system, safety net system or personal fall arrest system.  This violation occurred on or about June 18, 2012, on the south side of the commercial building where employees were exposed to fall hazard of 11 feet, 8 inches when painting the exterior surface of the building without a fall protection system.

29 CFR 1926.1053(b)(1):  Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  The employer does not ensure that when a portable ladder is used for access to an upper landing surface, the ladder side rails extend at least 3 feet above the upper landing surface to which the ladder is used to gain access.  This violation occurred on or about June 18, 2012, on the south side of the commercial building where employees were exposed to fall hazard of 11 feet, 8 inches when using an aluminum extension ladder to access an eave for painting without extending the ladder 3 feet beyond the landing of the eave.
