29 CFR 1910.134(a)(2): The employer did not establish and maintain a respiratory protection program which included the requirements outlined in 29 CFR 1910.134(c): a. An employee was exposed to respirable granite dust containing 16% crystalline silica (quartz) at a Time Weighted Average (TWA) of 0.9336 milligrams per cubic meter (mg/m3), approximately 1.68 times the limit of 0.556 mg/m3 while dry cutting the granite sink cutout. The sampling was performed during one shift on June 20, 2012. The exposure level was derived from a sample collected over a 291-minute sampling period. Zero exposure was assumed for the remaining 189 minutes. The employer had not established nor implemented a written respiratory protection program for employees using 3M 8210 N95 and Series 6000 half-face elastomeric respirators.

29 CFR 1910.1000(e): Feasible administrative or engineering controls were not determined and implemented to achieve compliance with the limits prescribed in 29 CFR 1910.1000(a) through (d): a. An employee was exposed to respirable granite dust containing 16% crystalline silica (quartz) at a Time Weighted Average (TWA) of 0.9336 milligrams per cubic meter (mg/m3), approximately 1.68 times the limit of 0.556 mg/m3 while dry cutting the granite sink cutout. The sampling was performed during one shift on June 20, 2012. The exposure level was derived from a sample collected over a 291-minute sampling period. Zero exposure was assumed for the remaining 189 minutes. The employer provided a single fan for general ventilation, and allowed the counter top to be cut using a dry method. Among other feasible means of abatement would be to utilize a wet method when cutting the granite counter tops or install a dust collection system that will collect the dust at the source of the operation.
