29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns: The employer does not ensure employees are protected by protective helmets while working in areas where there is danger from falling or flying objects. This violation was observed on or about June 18, 2012, on the South end of the scaffolding where employees were exposed to falling hand tools and concrete block while working on and around the scaffold without wearing a hardhat. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees are provided protective helmets to guard against head injuries caused from falling or flying objects.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. The employer does not ensure that open-sided floors or platforms six feet or more above lower levels are guarded by railings, safety-net systems, or a personal fall arrest system on all open sides. This violation was observed on June 18, 2012 on the North end of the construction site where employees were exposed to a fall hazard of more than six feet when walking along the top outside edge of the dumpster without utilizing a fall protection system. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that open-sided floors or platforms six feet or more above the adjacent floor or ground level are guarded by fall protection.

29 CFR 1926.701(b): All protruding reinforcing steel, onto and/or into which employees could fall or come against, was not guarded to eliminate the hazard of impalement: The employer does not protect employees from impalement hazards caused by unguarded rebar. This violation was observed on or about June 18, 2012, near the South side of the building site where employees were exposed to impalement hazards when they walked past the unguarded rebar while transferring scrap concrete block to a metal dumpster. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees are protected from impalement hazards caused by unguarded rebar.
